Supermarket judgment comment: Falana challenges judge’s summons

Human rights lawyer, Mr. Femi Falana (SAN), has said Justice J. D. Peters of the National Industrial Court lacks the jurisdictional competence to summon him for the purpose of explaining a comment credited to him (Falana) in the newspapers.

Falana, in a motion on notice he filed to challenge his invitation by Justice Peters, contended that the procedure adopted by the judge in inviting him was unknown to law.

Justice Peters, who sits in Courtroom 5 at the Lagos Division of the NIC, had recently issued a directive that Falana must appear before him on May 31, in respect of a comment credited to him (Falana) that “courts in Nigeria are supermarkets where justice is sold.”
